This agreement explains when and how you may use online software products from Splash Maritime Training. By initially using this software package you indicate your acceptance of the following End User License Agreement (EULA). In this agreement:
"Program" means the Splash Maritime Training or R. Hope software product(s) you use for evaluation, including both the software and the associated documentation and other materials, including but not limited to Splash Maritime Training;
"we" or "us" means Splash Maritime Training or R. Hope, ABN 74 685 528 403;
"you" means the end user of the Program.
”evaluation” means viewing the program online.
This is a legal agreement which allows you, the end user, to use the Program under certain terms and conditions. If you cannot agree to abide by what this Agreement says you should not use or evaluate the Program. The Program is copyrighted by and proprietary to R Hope, or suppliers. The non-exclusive licence set forth in this Agreement is not a sale of the Program or any copy. Except only as expressly set forth in this EULA all rights in and to the Program are reserved to R Hope, or suppliers.
You may use the Program for evaluation only. You agree not to install or use any individual copy of the Program. You may not loan, distribute, sub-licence or copy any portion of the Program; modify or prepare derivative works from the Program. Any attempt by you to sub-licence, assign or transfer any of the rights, duties or obligations contained herein is void; you may not use the Program in a computer-based service business or publicly display visual output of the Program; you may not modify, transfer, reverse assemble or reverse compile the Program. If you transfer possession of any copy of the Program to another party your license is automatically terminated.
The content of this program is supplied only as an additional aid for students already enrolled with a Registered Training Organisation. Splash Maritime Training makes all content and linked material available on the understanding that users exercise their own skill and care with respect to its use. Before relying on the material for assessment or in any important matter users should carefully evaluate the accuracy completeness and relevance of the information for their purposes and should obtain appropriate professional advice relevant to their particular circumstances.
The views and information expressed, extracted from or linked to contributing authors, websites, Organisations or Authorities are compressed for brevity. Users must consult the original source material for the full content. That is, they must consult the Authors, Websites, Organisations or Authorities for current, accurate and full information.
We accept no liability for the accuracy, currency or appropriateness for the user of the material in the program. Accordingly it is provided "as-is" and without warranty of any kind. We disclaim any and all warranties, express or implied, oral or written, including any implied warranties of merchantability or fitness for a particular purpose.
We cannot promise that the Program will be free of bugs or program errors, but if you report a program error or bug to us, we will do our best to correct it.
Limitation of liability: in no event shall we be liable for any incidental, consequential, or punitive damages whatsoever arising out of use of the program or your relationship with us. Note that some States do not allow exclusion or limitation of liability for incidental or consequential damages, and therefore the above limitation may not apply to you.
Splash Maritime Training accepts no liability for the quality or completness of any third party advertisers products and services on the website. Any claim or redress must be directed to the products and service originator.
